Legalities

It is very easy to get married in Ontario. There are no citizenship or residency requirements and blood tests or medical certificates are not required.

The person that performs the ceremony is the person that is authorised to marry you (unlike in the UK where it is the venue that is licensed) so you can get married anywhere - as long as your feet are on dry land to sign the marriage license and the ceremony can be held at any time.

If you want, you can write the ceremony yourself and the officiant will ensure that the words required to make it legal are incorporated.

If you are over 16 but under 18 you will need both sets of parents to complete a Consent of Parents or Guardians to Marriage Form.

If neither party has been married before, you will need a marriage licence which can be applied for online, then paid for in CASH and picked up in person from a nearby City or Town Hall. The licence will be valid for three months.

However, if either or both parties have been previously married, the divorce(s) will need to be recognised by the Ontario Registrar General’s office using a very specific method which CANNOT be circumvented.

  • 1 Marriage Licence Application ; See above

  • 2 Statement of Sole Responsibility for your divorce, signed by you and your new partner; the form is available online.

  • 3 An original or court-certified copy (certified by the proper court officer in the place the divorce or annulment was granted) of the divorce decree or annulment. If they are in a language other than English or French, you must include a translated copy and an affidavit sworn by a certified translator; and

  • 4 A legal opinion from a lawyer, giving reasons why the divorce or annulment should be recognised in the Province of Ontario.

    These four documents are sent off to the Office of the Registrar General who then returns a Foreign Divorce Authorization.
